Up to which age is one regarded as a child and young person respectively?

According to the Marriage and Family Relations Act (Official Gazette of the Republic of Slovenia, No. 69/04 – official consolidated text), one is regarded as a child up to eighteen years of age. It is at this age when a person is granted full legal capacity, which enables him or her to enter into legal transactions. While a minor, a child is represented by his or her parents.

Are children/teens allowed to stay in public places?

There is no legally fixed age in Slovenia on the national level before which children are allowed to stay in public places without being accompanied by their parents or legal guardians. Municipal decrees in several municipalities define that children under 15 or 16 years of age are not allowed to stay in public places unaccompanied by their parents or legal guardians.

Restaurants:

As regards the minimum age requirement for access of minors to restaurants, there are no legal provisions thereof.

Diskos:

It is forbidden for children under 16 years of age to enter and stay in night clubs, bars or similar entertainment districts, concerts, shows or other performances where alcohol beverages are served between 12 am and 5 am unaccompanied by parents, foster father or mother or a guardian.

This restriction is not valid if only non-alcohol beverages are served.

It is forbidden for children under 16 years of age to enter and stay in night clubs, bars or similar entertainment districts, concerts, shows or other performances where alcohol beverages are served between 12 am and 5 am unaccompanied by parents, foster father or mother or a guardian.

This restriction is not valid if only non-alcohol beverages are served.

Harmful Places:

There are no places in the Republic of Slovenia which are qualified as more dangerous than others, and there are no places where minors should not be present.

Places for gambling:

Children are not allowed to stay in casinos until they are 18 years old.

The Act Restricting the Use of Alcohol (Official Gazette of the Republic of Slovenia, No. 15/03) defines an alcoholic beverage as any beverage with more than 1.2 percent of alcohol by volume, and a spirit drink as any drink consisting more than 15 percent of alcohol by volume. In accordance with this Act, it is prohibited to sell or offer alcoholic beverages or drinks mixed with alcoholic beverages to people under eighteen years of age.

Which regulations are there concerning sexual relations with children/teens?

According to Criminal Act it is prohibited to have sexual intercourse or any other sexual action with a person who is not 15 years old.

It is also prohibited to cooperate in prostitution of another person (which also includes minors) or to use force, threat or use infatuating to gain or stimulate a person to become a prostitute.

Which restrictions are there if foreign young people want to work temporarily?

Young people who are citizens of European Union or citizens of Lichtenstein, Norway, Island (European economic region/space) or Switzerland have free access to Slovenian labour market and do not need a working permit. Young people who are citizens of third countries need working permit if they would like to work in Slovenia.

Employment relationship is entered into by employment contract. An employment contract may be concluded by persons who have reached the age of 15, otherwise the employment contract is null and void. Work may be carried out also on the basis of civil law contracts in cases laid down by law.

Students may also work temporarily through special students agencies but they must have a student status in Slovenia, which means that they have to study in Slovenia. Otherwise foreigners can only perform non profit work which is organized as youth camps and other periodical ways of cooperation of young people on international level and is organized by authorized organizations, schools, institutions, ministries or local communities.

To which institutions can children/teens turn to if they need help?

When in school, children can seek advice from a school psychologist or counsellor. Activities related to social assistance, i.e. preventing and resolving the social problems of individuals, families and population groups, are covered by the Social Assistance Act (Official Gazette of the Republic of Slovenia, No. 3/2007 – official consolidated text, 23/07 – as amended, 41/07 – as amended, 114/2006 – ZUTPG). This act confers powers on social work centres and, with them, certain tasks, including professional counselling and support in handling relationships between family members, child care and preparing families to assume their roles in day-to-day life. In particular, social work centres are active in the field of social prevention, first social help, personal attendance and helping families, and organising common actions for socially deprived groups. Social work centres can also provide other types of services and tasks if necessary for mitigating social distress and difficulties in particular environments. In addition, they can help children in need through their professional workers, who act as counsellors to the latter within the framework of their competences. Also working in this field are non-governmental organisations which provide counselling and other services to young adolescents. If children are in a tough situation they can also go to the nearest police office.
